تصویب نقشه‌های تفکیکی

ماده ۱۰۱ـ ادارة ثبت اسناد و دادگاهها موکلفند در موقع تقاضای تفکیک اراضی محدود شهر و حریم آن عمل تفکیک را طبق نقشه‌ای انجام دهند که قبلاً به تصویب شهرداری رسیده باشد نقشه‌ای که مالک برای تفکیک زمین خود تهیه می‌کند و برای تصویب به شهرداری در قبال رسید تسلیم می‌کند، باید حداکثر ظرف دو ماه از طرف شهرداری تکلیف قطعی آن معلوم و کتباً به مالک ابلاغ شود.

در صورتی که در موعد مذکور، شهرداری تصمیم خود را به مالک اعلام نکند مراجع مذکور در فوق، مکلفند پس از استعلام از شهرداری طبق نقشه‌ای که مالک ارائه می‌نماید عمل تفکیک را انجام دهند.

معابر و شوراع عمومی که در اثر تفکیک اراضی احداث می‌شود متعلق به شهرداری است و شهرداری در قبال آن به هیچ عنوان وجهی به صاحب آن پرداخت نخواهد کرد.
